In a dispute involving the enforceability of an arbitration provision contained in an employment contract, judgment of the district court denying appellant's Motion to Stay Proceedings pending the outcome of an arbitration proceeding while granting appellee's Motion to Enjoin the arbitration proceedings is affirmed where appellant waived its right to enforce the arbitration provision by initiating and pursuing litigation in the District Court.
