Pittsburgh League of Young Voters Educ. Fund v. Port Auth. of Allegheny County, 09-3352
In a constitutional challenge to the defendant's refusal to place in its buses a public campaign advertisement encouraging released felons to vote, judgment of the district court that defendant's denial amounted to viewpoint discrimination is affirmed where despite defendant's written policy against placing noncommercial ads, it had previously accepted such ads, several of which bore a resemblance to the plaintiff's advertisement.
