United States Third Circuit

Doe v. Indian River School District, 10-1819

In a constitutional challenge to the defendant-school board's long-standing policy of praying at its meetings, judgment of the district court upholding the policy is reversed where traditional Establishment Clause principles governing prayer in public schools applies to strike policy, because the legislative session exception articulated in Marsh is unavailable to defendant.
