In an action concerning a contract dispute over insurance coverage and arising from a 2008 plane crash, judgment of the district court dismissing appellant's complaint for declaratory judgment and granting summary judgment to appellee on its counterclaim is reversed where New Jersey law allows reformation on the basis of mutual mistake against a party that did not participate in the negotiation of a contract and that appellant sufficiently pled mutual mistake.
