Sloan & Co. v. Liberty Mut. Ins.Co., 10-1725

In an action for breach of contract claiming payment on the balance of a subcontract against a surety bond, judgment of the district court is: 1) reversed to the extent that it granted summary judgment to appellant on its interpretation of the subcontract and appellees’ claim for a proportional offset against fees incurred in previous litigation; but 2) affirmed with respect to appellant's waiver claim.
