United States Third Circuit

Pabon v. Superintendent SCI Mahanoy, 08-1536

In a petition for habeas relief from the conviction of defendant for first-degree murder, judgment of the district court denying petition as untimely is reversed because defendant made a substantial showing that his Sixth Amendment right to confrontation may have been violated, and where defendant's language inability, if true, coupled with the prison system's lack of Spanish-language legal materials or interpreters, would be extraordinary circumstances so as to equitably toll the limitations period for petition.
