Wilkins v. United Health Group, Inc., 10-2747
In a qui tam action based on the False Claims Act (FCA), 31 U.S.C. section 3729, Rule 12(b)(6) dismissal by district court is affirmed where court properly dismissed appellants' FCA allegations based on a violation of Medicare marketing regulations, but reversed where court erred in granting appellees' motion to dismiss an amended complaint based on its allegations that appellees submitted false claims to the Government by violating the Medicare Anti-Kickback Statute, 42 U.S.C. section 1320a-7b.
