United States Third Circuit

Warren General Hospital v. Amgen Inc, 10-2778

In an antitrust action involving whether whether plaintiff-hospital which purchas pharmaceutical products from a wholesaler middleman has standing, under Illinois Brick Co. v. Illinois, to bring a federal illegal tying claim against defendant-manufacturer, judgment of the district court dismissing action is affirmed where plaintiff was an indirect purchaser of defendant's products and thus lacked antitrust standing.
