J.S. v. Blue Mountain Sch. Dist., 08-4138
In a Section 1983 action challenging the imposition of punishment by defendant-school district for conduct that occurred on MySpace, judgment of the district court is affirmed in part where the relevant school policies were not overbroad or void for vagueness, but reversed in part where plaintiff's conduct was protected speech because it neither caused nor reasonably could have led school officials to forecast substantial disruption in school.
