Layshock v. Hermitage Sch. Dist., 07-4465
In an action challenging the imposition of punishment by defendant-school district for conduct that occurred on MySpace, summary judgment in favor of the plaintiff is affirmed where the school district cannot punish a student for expressive conduct that originated outside of the schoolhouse, did not disturb the school environment, and was not related to any school sponsored event because such conduct is protected speech.
