United States Third Circuit

US v. Diaz, 10-3337

In a sentencing dispute arising from the imposition of sentence on conviction of two counts of possession of a firearm in furtherance of drug trafficking in violation of 18 U.S.C. section 924(c), resentencing of defendant upon vacation of one of the counts is reversed where it is unclear that evidence of post-sentencing rehabilitation was considered when resentencing de novo.
