In a petition for habeas relief involving the adequacy of Pennsylvania's fugitive forfeiture rule for habeas purposes, judgment of the district court partially granting relief is affirmed in part and reversed in part where the application of a new fugitive forfeiture rule mandating dismissal by Pennsylvania courts constitutes a break from past discretionary practice.
