Abu-Jamal v. Secretary PA Dept Corr., 01-9014

In a petition for habeas relief arising from the capital sentence of defendant, a journalist convicted of killing a police officer, the judgment of district court granting petition is affirmed because Pennsylvania Supreme Court unreasonably applied Mills v. Maryland, 486 U.S. 367 (1988), to claim of reversible error by defendant on mitigation instruction.
