In a Section 1983 litigation, summary judgment in favor of defendant is affirmed in part and vacated in part where:1 ) district court held that police officers acted reasonably when they fatally shot plaintiff because abrupt, threatening movement by plaintiff justified the initial use of deadly force; but 2) whether force became unreasonable some time thereafter should have been reserved for determination by jury.
