Morris v. Beard, 08-9001

In an appeal of conviction for first-degree murder and robbery, the District Court's grant of an evidentiary hearing and subsequent finding that trial counsel's concurrent representation was an actual conflict of interest that deprived defendant of effective assistance of counsel, and grant of a new trial, is affirmed in part, vacated in part and remanded for further consideration of the request for a new trial.
