Consolidation Coal Co. v. Benefits Review Bd., 08-4651
The Benefit Review Board's (Board) affirmance of an ALJ's decision and order that petitioner must pay an employee benefits under the Longshore and Harbor Workers' Compensation Act (Act) for an injury he suffered while working for petitioner, is affirmed where: 1) the employee's employment satisfies the status requirement and the garage where he was injured satisfies the situs requirement of section 903(a); and 2) the Board did not err in determining that the employee's claim fell within the intended scope of the Act.
