United States Third Circuit

In a fraudulent claim action brought under the False Claims Act, district court's judgment is vacated and remanded where in light of the Supreme Court's subsequent decision in Allison Engine, which held that the funding mechanism by which fraudulent claims prompt the disbursement of federal funds via a federal grantee is instructive in determining whether a relator has stated a claim under the FCA, the court should reconsider its view that a relator can never successfully allege violations of the Act as they pertain to state transportation agencies.
