Nationwide Mutual Ins. Co. v. CPB Int'l, Inc., 07-4772

In a declaratory judgment action brought to determine insurance liability obligations, district court's grant of summary judgment for plaintiff is affirmed where the insurance policy did not required plaintiff to defend and indemnify defendant against a suit alleging breach of contract as the underlying claim was not covered by the terms of the policy since state law does not recognize the applicability of a general liability policy to breach of contract claim.
