AstenJohnson, Inc. v. Columbia Casualty Co., 07-2305
In a dispute over insurance liability coverage for claims related to asbestos exposure other than those involving asbestosis, district court judgement is affirmed in part and reversed in part where: 1) the court properly ruled that co-defendant American had no duty to defend or pay defense costs under the 1982 policy; 2) the court correctly denied plaintiff declaratory relief regarding the asbestosis exclusion clause; and 3) plaintiff is entitled to a jury trial on its other declaratory judgment claims.
