Brownawell v. Comm'r of Social Security, 07-4405
In a dispute involving the denial of disability benefits, district court judgment against plaintiff is reversed where: 1) the ALJ's disability determination was not supported by substantial evidence, as he relied on facts that were clearly erroneous in making a decision that failed to give appropriate weight to the opinion of plaintiff's treating physician; and 2) substantial evidence on the record indicates plaintiff is disabled and thus she should get benefits.
