US v. Hardwick, 06-2541

Convictions of multiple defendants for crimes related to a drug-dealing operation are affirmed where: 1) a waiver in a proffer agreement that allowed the government to use a defendant's proffer statements as part of its case-in-chief at trial was valid and enforceable; and 2) admission of that proffer statement did not violate the Confrontation Clause rights of other defendants who were implicated in the statement.
