In Re: Schaefer Salt Recovery, Inc., 06-4574
In a bankruptcy case in which petitioner was accused of deliberately filing his petition frivolously in order to forestall a foreclosure action, an order affirming a bankruptcy court's denial of sanctions and motion for reconsideration is vacated and remanded where the Bankruptcy Court is a unit of the district court and comes within the scope of section 451, and it had authority to impose sanctions under 28 U.S.C. section 1927.
