In re: Bath and Kitchen Fixtures Antitrust Litigation, 07-1520
In an antitrust action alleging a price-fixing conspiracy by manufacturers of bath and kitchen plumbing fixtures, an order striking plaintiffs' notice of voluntary dismissal is vacated and remanded where Fed. R. Civ. P. 41 allows a voluntary dismissal without prejudice at any time before defendants serve an answer or a motion for summary judgment, and defendants' filing of a 12(b)(6) motion to dismiss therefore did not foreclose the availability of voluntary dismissal under the rule.
