US v. Gunter, 07-1291
Sentence for drug- and firearms-related offenses is affirmed in part and reversed in part where the district court: 1) complied with controlling case precedents in considering relevant section 3553(a) sentencing factors when making a variance from the guidelines range; but 2) committed plain error in imposing a concurrent sentence which exceeded the statutory maximum for a charged violation.
