US v. Ozcelik, 06-4245

Conviction and sentence for bribery and attempting to conceal, harbor, and shield from detection an illegal alien is reversed in part and remanded for resentencing where: 1) defendant did not meet the burden of showing that the court's alleged error in defining the term "official act" in its jury instructions substantially affected the outcome of the proceedings; but 2) no reasonable juror could find that defendant's conduct tended to substantially facilitate an alien's remaining in the United States illegally.
