Chainey v. Street, 06-1061, 06-1256

In a case arising from a city's decision to halt repairs on houses rebuilt in the aftermath of the 1985 MOVE bombing, partial judgment against defendants is reversed and remanded in part where the trial court: 1) did not analyze the substantive due process claim or a Fed. R. Civ. Pro. 50 waiver issue; and 2) erred in not requiring individual proof of causation and damages.
