Frett-Smith v. Vanterpool, 06-4169

For purposes of diversity jurisdiction, only the American nationality of a dual national is recognized. In a diversity suit arising when a light fixture installed by defendants fell on plaintiff while she was working in the U.S. Virgin Islands, grant of defendants' post-trial motion to vacate an adverse jury verdict and to dismiss the complaint for lack of subject matter jurisdiction is affirmed where the parties were not diverse as required under 28 U.S.C. section 1332.
