United States Third Circuit

In a railroad operator's challenge to New Jersey regulations involving the transfer of solid waste from truck to rail car, a judgment in favor of the railroad is remanded for consideration of each individual regulation where the district court's factfinding did not support its conclusion that all of the state's environmental regulations at issue were preempted.
