Telcordia Tech Inc. v. Telkom SA Ltd., 05-1653

In a contract dispute involving plaintiff's provision of customized telecommunications software for defendant, a South African company, dismissal of plaintiff's petition to confirm a partial arbitral award is affirmed in part and reversed in part where, although the district court did have personal jurisdiction over defendant, considerations of comity and the proper interpretation of the New York Convention dictated that the petition be dismissed without prejudice.
