Berckeley Inv. Group, Ltd. v. Colkitt, 04-3844
In a dispute over an "Offshore Convertible Securities Purchase Agreement" between an individual looking for financing for a business venture and a Bahamian corporation, summary judgment and an award for the corporation is reversed in part where there was jurisdiction for the appeal, and the district court erred in dismissing defendant's Securities Exchange Act section 29(b) claim premised on a violation of section 10(b).
