United States Third Circuit

US v. Brownlee, 04-4134

A conviction for carjacking, using a firearm in relation to a federal crime of violence, and possession of a firearm by a convicted felon is reversed and remanded for a new trial where the district court erred in: 1) excluding expert testimony regarding the reliability of the eyewitness identification evidence upon which defendant was convicted; and 2) admitting defendant's inculpatory statements which were the product of a custodial interrogation without Miranda warnings.
