United States Third Circuit

US v. Grier, 05-1698

In the context of US v. Booker, facts relevant to the advisory US Sentencing Guidelines do not implicate the constitutional right to proof beyond a reasonable doubt. A sentence for being a felon in possession of a firearm is vacated and remanded pursuant to a claim that the district court erred in imposing sentence without fully articulating its consideration of statutory factors. (Amended opinion)
