United States Third Circuit

Luntungan v. Attorney Gen. of the US, 05-2397

A petition for review from a denial of a motion to reopen removal proceedings is denied over petitioner's claim of ineffective assistance of counsel where another motion to review, filed prior to the motion under review, had given petitioner a fair chance to be heard even if he had received ineffective assistance of counsel on his first motion to reopen.
