Dismissal of an American Indian nation's claim to a portion of its aboriginal land for failure to state a cause of action is affirmed where any aboriginal rights held by the tribe to claimed land were extinguished via the Walking Purchase of 1737, and the tribe did not hold fee title to the land at issue.
