US v. Tupone, 04-2832
A sentence for making false representations in connection with the receipt of federal workers' compensation benefits is vacated for resentencing pursuant to Booker, and also where the district court erred in finding that the amount of benefits defendant received as a result of his false applications constituted a "loss amount" under the sentencing guidelines.
