US v. Leahy, 03-4490, 03-4542, 03-4560

Defendants' convictions for engaging in, and aiding and abetting, bank fraud are affirmed over claims regarding: 1) jury instructions as to the government's burden under the bank fraud statute; 2) sufficiency of the evidence, and 3) the scope of the bank fraud statute, 18 U.S.C. section 1344. Defendants' sentences, and forfeiture and restitution orders are vacated and remanded per Booker.
