US v. Leahy, 03-4490, 4542, 4560, 2912, 4184

Restitution under the Victim and Witness Protection Act and the Mandatory Victims Restitution Act is a criminal penalty and the Sixth Amendment right to jury determinations of certain facts, as articulated in Booker, does not apply to forfeiture or to orders of restitution imposed as part of a criminal sentence under those two statutes.
