US v. Coles, 04-2134

Defendant's conviction and sentence for drug-related crimes is vacated pursuant to a claim of improper denial of a motion to suppress where the exigent circumstances exception to the warrant requirement did not justify a warrantless entry and search of defendant's hotel room since police impermissibly created the very exigency at issue.
