United States Third Circuit

Szehinskyj v. Attorney Gen. of the US, 04-3710

Petition for review of a determination of removability is denied where petitioner is estopped from relitigating the issue of persecution, since a citizenship revocation proceeding fairly adjudicated the issue of his assistance in Nazi persecution under a law whose provisions are identical to the removal statute at issue.
