Mendez-Reyes v. Atty Gen USA, 04-4522

In an appeal from an Immigration Judge's denial of cancellation of removal, the court affirmed and noted that the requirement of ten years physical presence in the United States for cancellation of removal was broken by the alien's prior voluntary departure under threat of deportation.
