HUBBARD v. TAYLOR, 03-2372

Dismissal of plaintiff-pre-trial detainees' claim of unconstitutional confinement is reversed where the district court improperly analyzed their claim under the Eighth Amendment, rather than the Due Process Clause of the Fourteenth Amendment.
