BERISHAJ v. ASHCROFT, 03-1338

Plaintiff's petition for review of his claim for asylum and withholding of removal is granted where the Immigration Judge erred by 1)incorrectly making an adverse credibility determination, and 2 misapplying the law in concluding that changed conditions in Montenegro obviated plaintiff's persecution claims.
