United States Third Circuit

BOURIEZ v. CARNEGIE MELLON UNIV., 03-1709

District court erred in granting defendant's motion to compel arbitration. Plaintiffs are not bound by the arbitration clause in the 1996 agreement that funds certain research projects; they did not sign the agreement, did not benefit directly from it, and were not involved in the funding until 1999.
