MARINO v. INDUS. CRATING CO., 02-4429

Plaintiff, a journeyman electrician working with riggers on a task associated with a construction project at the time of his injury, was not a "special employee" of the rigging company under New Jersey law. Thus, he is not precluded from pursuing this negligence action against the rigging company.
