An exception exists to the notice requirement of FRCP rule 56(c) in cases where summary judgment is granted sua sponte, subject to the meeting of three conditions: 1) the point at issue is purely legal, 2) the record was not fully developed, and 3) the failure to give notice does not prejudice the party.
