OMNIPOINT COMMUNICATIONS ENTERS., L.P. v. ZONING HEARING BD. OF EASTTOWN TOWNSHIP, 02-2194

An ordinance, which purportedly fails to provide a "fair share" of township land for telecommunications uses, is neither de jure nor de facto exclusionary. The existence of a significant gap in telecomm service need not include the data from the applicant provider.
