United States Third Circuit

IN RE: PPI ENTERS., INC., 01-4140

Where Bankruptcy Code section 502(b)(6), capping a landlord's claim in bankruptcy for damages from lease termination, alters a creditor's non-bankruptcy claim, there is no alteration of claimant's rights for purposes of impairment under section 1124(1). Commercial tenant's bankruptcy filing did not contravene the Code's good faith requirement.
