The Supreme Court's decision in County of Sacramento v. Lewis, 523 U.S. 833 (1998), has superseded prior 3rd Circuit decisions holding that a plaintiff asserting that a municipal land-use decision violated substantive due process need only show that the municipal officials acted with an "improper motive."
