United States Third Circuit

GAGLIARDO v. CONNAUGHT LABS., INC., 01-4045

Symptoms from multiple sclerosis substantially limited plaintiff's major life activities of concentrating and remembering. 42 U.S.C. section 1981a permits apportionment of damages between claims under a capped federal statute (ADA) and uncapped state statute (Pennsylvania Human Relations Act), so that plaintiff gets the maximum amount of the jury award legally available.
