The Secretary of Health and Human Services correctly concluded that section 152(b) of the Medicare, Medicaid, and SCHIP Balanced Budget Refinement Act of 1999 served to reclassify hospitals into the New York City metropolitan statistical area for wage index purposes, and application of the "reclassification exclusion" policy to certain hospitals was not arbitrary and capricious.
